Throughout these Terms and Conditions, the following words carry the meanings set out below:

• "Zuriat", "We", "Us", or "Our" refers to Zuriat, a legal services practice registered and operating from No. 21, Jalan Molek 1/30, Taman Molek, 81100 Johor Bahru, Johor, Malaysia.
• "Services" refers to all estate planning, estate administration, and generational legacy engagement services offered by Zuriat, whether described on this website or agreed separately in writing.
• "Client", "You", or "Your" refers to any individual or family engaging Zuriat's services or using this website.
• "Agreement" means these Terms and Conditions together with any engagement letter or service confirmation issued by Zuriat.
• "Website" refers to the site operated by Zuriat at zuriat.live.
• "Content" refers to all text, documents, summaries, and materials produced by Zuriat in the course of delivering Services.

2. Acceptance of Terms

By engaging our Services or using this Website, you represent and confirm that:

• You are at least 18 years of age, or the legal guardian acting on behalf of a minor beneficiary.
• You have the legal capacity to enter into a binding agreement under Malaysian law.
• All information you provide to us is accurate, complete, and not misleading.
• You are acting in your own right or have proper authority to act on behalf of an estate or family group.

If you are engaging our services on behalf of another person or an estate, you warrant that you have the necessary authority to do so and to bind that person or estate to these terms.

3. Service Description

Zuriat provides specialist inheritance law services in Malaysia, including:

• Estate Planning Conversation (RM 560): A structured session for individuals preparing a will (wasiat), or considering hibah and trust arrangements, with written guidance notes provided.
• Estate Administration Support (RM 1,220): Assistance for families navigating probate, letters of administration, and authority liaison following a bereavement.
• Complete Generational Legacy Engagement (RM 1,900): End-to-end case management covering estate planning, administration, and distribution under faraid or civil law principles, including a consolidated estate record.

Specific scope, deliverables, and timelines for each engagement are confirmed in writing at the time of instruction. Zuriat reserves the right to decline an engagement where a conflict of interest exists or where the scope falls outside our practice areas.

Our Services are directed at individuals and families in Malaysia. International matters may be considered on a case-by-case basis.

4. User Responsibilities

When engaging Zuriat, you agree to:

• Provide accurate, complete, and timely information necessary for us to deliver the Services.
• Notify us promptly of any changes to your circumstances that may affect the engagement.
• Respond to reasonable requests for documents, information, or instructions within an agreed timeframe.
• Not use our Services for any unlawful purpose or in any way that may expose Zuriat to legal liability.
• Treat our practitioners and staff with courtesy and respect.

Delays caused by incomplete instructions or documents may affect agreed timelines. Zuriat is not liable for delays arising from the conduct or inaction of third parties, including government departments or financial institutions.

5. Intellectual Property

All materials produced by Zuriat — including written summaries, estate records, templates, and guides — remain the intellectual property of Zuriat until fees are settled in full, at which point documents prepared specifically for your matter become yours.

The content of this Website, including text, structure, and design, is owned by Zuriat. You may print or download content for your personal reference only. You may not reproduce, distribute, or republish any content without our prior written consent.

6. Fees and Payment

Our service fees are as described on this Website and confirmed in your engagement letter. All fees are quoted and payable in Malaysian Ringgit (RM).

• Payment terms are set out in your individual engagement letter. A deposit may be required before work commences.
• Accepted payment methods are confirmed at the time of engagement.
• Fees may be reviewed from time to time. Any change affecting an existing engagement will be communicated to you in writing before it takes effect.
• If your matter is more complex than initially anticipated, any adjustment to fees will be discussed with you before additional work proceeds.

Refund Policy

Where a consultation has not yet taken place, a refund of any deposit paid may be requested with at least two full working days' notice. Once a session has commenced or documents have been prepared, fees for work completed are non-refundable. Any unused portion of a prepaid fee will be considered on reasonable request.

7. Confidentiality

We treat all information shared with us in the course of an engagement as strictly confidential. We will not disclose your personal or estate information to third parties except where required by law, with your express consent, or where disclosure is necessary to carry out the Services (for example, liaising with the relevant courts or authorities on your behalf).

This obligation of confidentiality continues after the conclusion of any engagement.

8. Professional Advice Disclaimer

The information on this Website is provided for general reference only and does not constitute legal advice. Every estate is different, and outcomes depend on individual circumstances, applicable law, and the decisions of relevant authorities.

Nothing in our website content, written summaries, or initial consultations should be relied upon as a substitute for formal legal advice specific to your situation. Where formal advice is required, this will be set out in an engagement letter.

Zuriat does not provide financial planning, taxation, or investment advice. Where such matters arise, we will recommend that you consult the appropriate professional.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law:

• Zuriat's total liability to you in connection with any engagement shall not exceed the fees paid for that specific engagement.
• We are not liable for indirect, consequential, or speculative losses, including loss of inheritance value, delays caused by third-party authorities, or decisions made by you based on general website information.
• We are not responsible for delays or failures arising from circumstances beyond our reasonable control (force majeure), including court closures, system failures, or legislative changes.

Nothing in these terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold Zuriat, its practitioners, and staff harmless from any claims, losses, or costs (including reasonable legal costs) arising from your breach of these terms, the provision of inaccurate information, or your use of the Services in a manner inconsistent with applicable law.

11. Termination

Either party may bring an engagement to a close by giving reasonable written notice. In the event of termination:

• Fees for work completed up to the date of termination remain due and payable.
• We will return documents belonging to you, subject to any outstanding fees being settled.
• Obligations of confidentiality and any provisions that by their nature should survive termination will continue to apply.

Zuriat may terminate an engagement immediately where a conflict of interest arises or where continuing would breach professional or legal obligations.

12. Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these terms or our Services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Before commencing any formal proceedings, we ask that you contact us in writing to allow an opportunity for informal resolution. Most concerns can be addressed through direct discussion, and we are committed to addressing complaints thoughtfully and fairly.

Where a matter cannot be resolved directly, you may also seek guidance from the Malaysian Bar Council or the relevant Johor Bar Committee.

13. General Provisions

• Entire Agreement: These Terms and Conditions, together with any engagement letter, constitute the full agreement between us for the relevant Services.
• Severability: If any provision is found to be unenforceable, the remaining provisions continue to apply in full.
• Waiver: A failure to enforce any right does not constitute a waiver of that right on future occasions.
• Assignment: You may not transfer your rights or obligations under these terms without our prior written consent.
• Notices: Formal notices should be sent in writing to the address or email set out below.

14. Changes to These Terms

We may update these Terms and Conditions from time to time. Any changes will be posted to this page with a revised effective date. For ongoing engagements, we will notify you of material changes directly. Continued use of our Services following any changes constitutes acceptance of the revised terms.
